Consent in the context of Aarogya Setu

“Don’t deny services to people, stop collecting data through Aarogya Setu” said Petitioner Anivar Aravind, as he sought a permanent injunction against the use of the contact tracing app in the Karnataka High Court. Aravind’s argument extended to the app’s Open API Services Portal through which third party apps can check users’ health status “with consent”.

Is consent a given? How will consent be preserved in an era of privacy laws when the government assumes consent as a given in the case of Aarogya Setu app? Will consent not be sought in the context of pandemic and health hazards?

We discuss these and more questions, with Anivar, in the context of the court case.
